DMCA Copyright Policy
1. Digital Millennium Copyright Act Compliance
SpellCastings respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our service that are reported to our designated Copyright Agent.
2. Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our service, please notify our Copyright Agent. Your written notification must include:
Required Information for DMCA Notice:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including the specific URL(s) where the material is located.
- Your contact information: name, address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
3. Counter-Notification Procedure
If you believe that material you posted was removed in error, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the removed material and its former location
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number, and consent to jurisdiction of the federal court
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, SpellCastings has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also limit access to the service and/or terminate accounts of users who infringe intellectual property rights of others.
